1. Who these terms are between

These terms govern the use of the application Alta Agentie Ads API ("the application"), operated by ANOTHER AGENCY S.R.L., a company registered in Romania, Trade Register number J15/1683/2018, tax identification number RO40293929, with its registered office at Calea Domnească nr. 330, Târgoviște, județul Dâmbovița ("we", "the agency").

2. Who may use the application

The application is an internal tool. Access is limited to employees and contractors of the agency who have been granted an account and who authenticate through the agency's Google Workspace domain. The application is not offered to the general public, is not available for sign-up, and is not sold, sublicensed or otherwise made available to third parties.

Clients of the agency do not access the application directly; they receive its output in the form of reports.

3. What the application may be used for

The application may be used only to report on, and manage, advertising accounts for which the agency holds a written mandate from the account owner and to which the agency has been granted management access on the relevant platform. Authorised users must not:

• use it to access any advertising account outside the agency's manager account hierarchy;
• export or disclose a client's data to anyone other than that client, except where required by law;
• share credentials, tokens or access with anyone outside the agency;
• use it in a way that breaches the Google Ads API Terms and Conditions, the Meta Platform Terms, or the advertising policies of either platform.

4. Platform terms

The application integrates with the Google Ads API and the Meta Marketing API. Use of the application is additionally subject to the terms and policies of those platforms, including the Google Ads API Terms and Conditions, the Google API Services User Data Policy and the Meta Platform Terms. Where these terms conflict with a platform's terms, the platform's terms prevail in respect of that platform's data.

5. Client data

Data retrieved from advertising accounts remains the property of the account owner. The agency processes it as described in the Privacy Policy and in the service agreement with the client concerned. On termination of a client relationship, the client may request deletion of their data as set out in our data deletion instructions.

6. Availability

The application is provided on an "as is" and "as available" basis for internal use. We do not guarantee uninterrupted availability. It depends on third-party APIs whose availability, rate limits and functionality are outside our control, and which may change or be withdrawn by Google or Meta at any time.

7. Liability

To the extent permitted by Romanian law, the agency is not liable to authorised users for indirect or consequential loss arising from use of the application. Nothing in these terms limits the agency's liability to its clients under the service agreements concluded with them, or any liability that cannot be excluded by law.

8. Changes

We may amend these terms as the application changes. The current version is always published at this address, with the date of the last update shown above. Continued use of the application after an update constitutes acceptance of the amended terms.

9. Governing law

These terms are governed by Romanian law. Any dispute that cannot be resolved amicably falls under the jurisdiction of the competent courts in Romania.
